Hello,

I am about to send off a full song I created in Garage Band to
A professional recording house so they can mix and master
The track. I composed all music, lyrics, vocals and instruments
myself. I live in Canada, but the recording studio is in California.

My question is, by default does the recording house have any
Rights to my song after they have mixed it and mastered it?

They may do some trivial minor fixes like re-do a harmony line
but that's it.

And are they able to copyright my song without my consent?

Confused about this .... if anyone can help I would be very great full!

Hi Treblebass,
Their are far more knowledgable on the subject but in my experience I got a producer to do a couple of songs and it was on a "Work for Hire agreement" which to my understanding is no they have no rights.
Im sure a few others will be able to give you a complete overview of the subject,

1. No. They are doing work for hire and they are NOT contributing anything to the mix. Mixing and mastering is not something they can claim copyright on. Their contract with you should explain that to you.

2. Technically..... no. Possibly ... perhaps. There's nothing to stop anyone who obtains a copy of your work to file a copyright. Will it happen? The chance is close to zero. As in zero dot zero, zero, zero zero, zero one. (just a guess, probably even less) You should always deal with reputable people. I'm sure there's a Canadian copyright office for you. If you fear someone might steal the song.... not very likely at all.... you should pay the copyright office in Canada and get the song covered so you can sleep better at night.

In reality, the chance of someone stealing you song is infinitesimally small. Most songs are not worth stealing. Yeah I know that's hard to believe because you, me and everybody else just wrote the next multi-platinum world wide smash single..... but the reality is quite the opposite.

But I answered the questions.... hope it helps.

Me? I'd copyright it first.

As Guitarhacker said, the chances of them stealing the song are close to zero. On the other hand, if you've already thought about someone stealing it, it will give you piece of mind to have a legal copyright.

If you are investing in the creation of the final product, you should also invest in copyrighting it. And since copyright is for a pretty long period of time, music tastes change over time. Songs that didn't do well originally sometimes have a rebirth decades later, because it was the right time. You should protect your intellectual property.

The cost to copyright in the USA is $35. You can copyright one MP3, manuscript or you can fill a CD full of MP3s for $35. As you can see it is cost effective to load a CD with MP3s.

I used to own a sailboat. Reefing the sails means taking them in to make them smaller. You do this when the wind is very strong for safety reasons.

There is something they teach you in sailing school. When you think about reefing the sails it's time to reef them.

I'd say the same thing applies to your copyright question.

This is relatively easy to do.

But, the last time I did it was in 1997 and that was mailing back paper forms and a cassette tape. And, it was easy then.

You can also claim the song, in your form, by publishing it. Publish means to make it available on a certain date to the public. If you post it on YouTube with audio and lyrics it will be "published".

From what I understand, if the producer makes significant changes to your song he/they can claim they are co-writers of the song. If they change the form, melody, add parts that were not in your form, especially lyrics they are essentially co-writing. And, I think, all/each co-writer/s has 100% legal ownership of the song. Having a written contract/agreement dated prior to any claim of ownership is simplest way to prevent them from claiming ownership.
When others see that you have taken steps to claim your song as yours they are not likely to pursue it unless they offer you some kind of exchange in return. That might be money, royalties or that might be "written by you" on all published and reproduced copies.
