I'm in the process of creating a SoundCloud account and have encountered the "buttons' that seem to be making me choose between reserving all rights and opening some by various permissions under Creative Commons.

I don't hold a formal, registered copyright on any of my songs. I've gotten advice that it isn't necessary for someone unless and until a Publisher for Profit shows interest. When posted at Acid Planet (or at Alonetone since I stopped at AP) I understand that I "assumed" copyright simply by publication. AP is now defunct, though most of my "important" works were also "published" at Alonetone even before that happened...albeit at different dates.

I managed to download my "pages" at AP before it went under, so I still have (perhaps) some record of when it was first made public.

Up to speed.

I consider myself a song-writer and not (necessarily) a recording artist. I know that there is a difference in copyright between the creative work (publishing) and the recorded work (mechanical), so most of my concern is toward the "publishing" end.

I'd dearly love for not only an established artist but for a less-than-established artist to record my songs and get them heard by people who would never find or listen to me. Obviously, though, if that were available commercially, baby needs a new pair of shoes.

So I'm at a loss as to which rights to keep and which to share. I don't mind a bit people using my recordings simply with attribution. if it is non-commercial. That's been done before and all I asked was "credit" and that the work it appeared in not be pornographic. LOL. I'd want more say if someone was to make a derivative work (which I am assuming, perhaps wrongly) would include their own recorded version of the song.

Some guidance? Correction?

By the way, I am not a member of a PRO, though it's possible I joined one years ago. You got any thoughts on that, I'm listening. I'm really not trying to "break-in" to the music business. I just want credit where credit is due, and cash where cash is due. I have no expectation of either.

My theory is don't share anything or give away anything that you want to keep and control.

ALWAYS reserve your rights. I never let my music go to the creative commons or PD.

There are 2 general types of publishers. Non-exclusive and exclusive. The exclusive ones want 100% of the publishing and the Non-exclusives don't. exclusives will place a song into a commercial use. No one else, including you can use that song without permission. Non-exclusive means just that. They will use it if they can but they do not prohibit you or anyone else from using it as well. Many of these publishers will "re-title" the song so they can be sure of where it came from because there may be several libraries all pitching the same song to one project. They all re-title it.

Letting it become creative commons or PD....The problem would come later IF.... you found a publisher or music library that wanted to place your song commercially and was requiring that you control 100% of your rights. It is very common that they want you to control your song 100%. If you have given the rights away, and allowed others to use the song in a commons type, or PD agreement, the publisher will pass on your song.

Copyright.... you don't need a copyright on your songs for most uses commercially. I have a bunch of non-copyrighted songs in music libraries, and several are in films and TV shows. I still get the royalties from airplay regardless of copyright. If a publisher (exclusive) signs your song, they will obtain the copyright on the song to protect it..... in their name. You still get writing credits and royalties, but you do not own your song at this point. If you have a recapture clause, you can recapture your rights after a specific amount of time IF they have not caused it to be used commercially in that time frame and if you terminate the agreement according to the termination clause in the contract. If you do manage to get it cut commercially, they retain ownership according to the time limit rules for the country you live in.

You should join or reestablish your membership in the PRO of your choice or the one you joined some time back. You don't get paid for airplay any other way. I had no clue my songs were in a TV show until a BMI check showed up in the mail, payable to me.
