I have been recently contacted by someone who wants me to sell them my arrangement of a classical music public domain piece I made, without its melody (i.e just the accompaniment / backtrack). I made that accompaniment track with Band-in-a-Box.

I understand that I can do that (i.e. sell it) legally, and have that in writing from PG Music staff. Please correct me if I'm wrong, though - thanks!

My question is: how much to charge? I've never done this before. Does it depend on what kind of license I give this person? If so, what kinds of licenses are there, and how much do I charge for each one?

First rule of negotiating; start high.
You can always come down.

It also depends on what the purchaser is willing to pay of course.
And its intended purpose .. if for commercial use I would consider talking to someone legally knowledgeable.

I only say that because early on I sold some work pretty cheap only to find it was being used on a TV show regularly .. which should have meant recurring as well as initial price had I done it right. Live and learn.

If you have it writing from the professors, don't ask the other students...



I am using the new 1040XTRAEZ form this year. It has just 2 lines.

Interesting given that it’s PD with no melody and also given that chord progressions alone are not subject to copyright. But I’m light years away from being a licensing expert. I do understand that PD arrangements can be copyrighted as we’ve done that many times but with a melody. Of course if it was on Songtradr you could easily negotiate a license and retain all rights … but ST would get a cut.

A good audio file backing track on the web goes for anywhere between $6 and $12 USD. That is for a cover song with NO legal restrictions. Or have you created a new song including melody? In that case anywhere between $10,000 to as much as the lawyers can negociate.

Absolutely.

Yes, what you create with PG music's BB/RB is 100% yours. When you sell the track, YOU ARE NOT RESPONSIBLE for paying any royalties or copyright issues. You are doing a work for hire agreement to provide tracks. You don't sell or give him a license. You create the work for a specified amount and in the written agreement you relinquish any and all claim to the music. You get paid, he gets the music. It is the end user's responsibility to worry about copyright and licenses if he plans to release it commercially.


How much to charge: As much as you want and can get. You can always negotiate down. I charged $150USD (if I remember correctly) for a project I did for a fellow about 10 years ago. He approached me about doing a track for him, and I worked with him to get what he wanted and was satisfied with. My price for the work per hr involved was very low, but it was fun and I wasn't intending to try to pay the light bill with it. Since you already have it finished, this is like icing on the cake. Give him a good deal on the price.... complete a WFH agreement and make the deal.

Guitarhacker: yes, a Work-for-Hire (WFH) agreement sounds to me to be the exact way to go forward with this. I shall do exactly that! Thanks to you and everyone else, once more, for taking the time to help me out!!! :-)
