wenn man stücke mit realtracks kreiert, und die öffentlich verwendet. Oder angenommen , so ein stück wird ein Hit. Wem gehören dann die Urheberrechte? band in a Box oder dem Komponisten?

Da die Realtracks Bestandteil von Band-in-a-Box sind, gehe ich davon aus, das damit die Information aus den FAQ auch hier gilt:

Die Urheberrechte eines von Anton komponierten potentiellen Hits liegen - vorausgesetzt er ist nicht ganz oder in Teilen ein Plagiat - in jedem Fall bei Anton.

Echte Studiomusiker, die einzelne Spuren eines Stückes im Studio einspielen - halten ja schließlich auch keine Urheberrechte an dem Stück. Die liegen stets beim Komponisten und Texter, deren Erben oder wurden einem Verlag abgetreten.
RealTracks sind "virtuelle Studiomusiker". Die Rechte der "echten Studiomusiker" sind daher i.d.R. mit der Bezahlung für den Studiojob abgegolten, die Rechte der "virtuelle Studiomusiker" alias RealTraks, bzw. von PGMUSIC als Softwarepublisher, mit dem Kauf der Software.

Das müsste auch für die RealTracks-Solisten und den Melodisten gelten, da ja Soli und Melodie auf der Grundlage der eingegebenen Harmonien automatisiert generiert werden und kein eigenständiges "schöpferisches Werk" darstellen. Das urheberrechtlich relevante "schöpferische Werk" erbringt wiederum einzig der Komponist (Anton). Die "programmiertechnische Leistung" der Soli-Generierung wurde bereits mit dem Kauf der Softwarelizenz bezahlt.

Die einzig offenen Frage stellt sich m.E. noch, wenn man ein Stück komplett von BiaB oder RealBand automatisiert generieren lässt. Also Harmonie, Melodie, Soli etc. ohne selber irgend etwas zu ändern. Da aber so ein Stück trotz der Kompetenz von BiaB und RealBand eh kein Hit werden dürfte, wäre diese Frage ohnehin rein akademischer Natur.

Übrigens: Anton müsste die Rechte an seinem Werk anmelden und belegen. Infos dazu z.B. bei der GEMA.
