Many of us are users or at least aware of the many "music distributors' out there, e.g., CDBaby, Songtradr and many others. They typically charge a one time fee for each Album or single distribution or a monthly fee for becoming a member of the company. They rarely charge a commission on sales and they handle getting the money to you w/o charge.

So, I was wondering what would happen if a distributor went bankrupt? Or if you quit paying your membership? The streaming platforms, e.g., Spotify, Apple, Amazon, etc., would still have your album and presumably folks would still play it. But how would the money get to you in the absence of the distributor you signed on with? Or in the case of Songtradr how would you get paid your album fees AND individual licenses handled by them?

We are happy with Songtradr's distribution and licensing of our songs but I remain curious as to what would happen if they or any of the other distributors tanked. It's not like we couldn't live w/o the whole $75 or so we get each qtr smile just got to thinking about it and wondered if anybody else had.

I don't think there is any way to know just what would happen if Apple or Amazon went bankrupt. That is a complex legal issue that the bankruptcy courts would decide. Those two are huge companies. I don't know much about Spotify but I assume things would not be much different. There would be some time frame that the company would have some protection by filling bankruptcy under chapter 11 if they had the intent to reorganize. Chapter 7...I am not sure...just disappeared...who knows

I "ASSUME" your contract would be void with any company that went bankrupt and the contracts were not bought by some other company due to the fact they could not provide the services they agreed to and therefore would be in breach of contract.

If your contract becomes void due to breach of contract for any reason then you would have legal recourse to have your music removed from their control.

Another part of this picture is the huge liability any company would have to sell your music in a condition that is not legal...super big bucks for copyright infringement.

The bottom line...all this would require the services of a music attorney and cost money...generally a lot of money...unless you could contact them and settle the issue your self.

Your decision of how to proceed would be based on the cost/benefit ratio.

I am not an attorney so this is not legal advice and in fact may not be 100% correct. But, I don't think it is too far off.

I'm not talking about the streaming platforms (Amazon, Apple, Spotify, etc.) but rather your distributor (Songtradr, CDBaby, and many more). The platforms would still have your songs but how would the payment get to you if the distributor went bottom up?

I've read where some artists have "pulled" specific works from online platforms for various reasons, A recent example is the artist, Pink, pulled some material that is a collaboration with another artist that has been accused of gender harassment.

Evidently if an artist requests removal of their material the request is normally honored. I suspect you would have to request removal and find another vendor to redistribute and monetize it.

We might have read the same article. This is becoming more and more common. The metal band Tool also removed their music from many major streaming services.

If a company goes out of business for one reason or another and they have tangible income producing assets.... there will be another company pick up those assets or at the very least they will be managed and administered by a company assigned by the judge of the bankruptcy court.

They are not going to just disappear. If they do disappear, there's no revenue stream to worry about anyway.
