So....this might not matter at all to anyone here, and it's probably not going to cause much of a ripple in the big pond.....

However, I write music that gets submitted to film and TV projects for sync licensing. One of my publishers just sent notice that their very strict "NO-AI" policy is to now include hosting music on Soundcloud. We can use Soundcloud for hosting BUT, not for anything we plan to submit. If any music hosted on Soundcloud is submitted for sync to this pub, .... well, lets just say, it's not advisable. This particular publisher is easily the strictest one in the business that I have worked with. All my submissions to all my publishers are in a private Box account that no one has heard but me and that publisher.

"...You explicitly agree that your Content may be used to inform, train, develop or serve as input to artificial intelligence or machine intelligence technologies or services as part of and for providing the services."

So.... your music, hosted on Soundcloud, can be used, without your knowledge, permission, or compensation, for the training of AI models that are obviously paying Soundcloud for the data.

Just so you know.

And yeah... I've got a few SC accounts with a couple dozen songs..... I'll most likely be looking into moving them elsewhere soon.

I too am looking for a new place to host my files now. I'm guessing though, that this is just the beginning of the theft we are about to see . . .

It's interesting that their email says one thing that their updated terms and conditions appears to contradict. Perhaps their intent is to (try to?) protect themselves from action in the event the content gets used by others, but their T&Cs still seem toi give them permission.

If there's enough of a ground swell, it's likely that SC will reverse itself. I'm not going to do anything rash quite yet

Lets face it. Most, if not all publicly accessible content had been picked already.
Having said that, it seems there had been an update from SC:

“SoundCloud has never used artist content to train AI models, nor do we develop AI tools or allow third parties to scrape or use SoundCloud content from our platform for AI training purposes. In fact, we implemented technical safeguards, including a ‘no AI’ tag on our site to explicitly prohibit unauthorized use.

The February 2024 update to our terms of service was intended to clarify how content may interact with AI technologies within SoundCloud’s own platform. Use cases include personalized recommendations, content organization, fraud detection, and improvements to content identification with the help of AI technologies.

Any future application of AI at SoundCloud will be designed to support human artists, enhancing the tools, capabilities, reach, and opportunities available to them on our platform. Examples include improving music recommendations, generating playlists, organizing content, and detecting fraudulent activity. These efforts are aligned with existing licensing agreements and ethical standards. Tools like [those from our partner] Musiio are strictly used to power artist discovery and content organization, not to train generative AI models.

We understand the concerns raised and remain committed to open dialogue. Artists will continue to have control over their work, and we’ll keep our community informed every step of the way as we explore innovation and apply AI technologies responsibly, especially as legal and commercial frameworks continue to evolve.”

Although I have a commercial SoundCloud account, I’ve never used it much. No longer seeing any reason to do so.

SoundCloud seems to be saying that THEY, SoundCloud have never themselves, personally used their catalog to train AI.... But stop short of saying they haven't, or aren't allowing others to do that very thing.


Reading the actual terms of use agreement is rather confusing. In the Grant of license section where it discussed this topic, it seems to say yes they do allow training and in the next section they seem to say the opposite. The end of paragraph 2 into paragraph 3 where it says.... And I quote from the agreement itself:

"You explicitly agree that your Content may be used to inform, train, develop or serve as input to artificial intelligence or machine intelligence technologies or services as part of and for providing the services. For the avoidance of doubt, neither SoundCloud nor any third party is allowed to (i) use, copy or

reproduce any Content delivered to the Platform under separate agreements, which is owned or controlled by third party rights holders (including artwork, images, logos, audio and audiovisual recordings (and any part thereof), underlying musical works and lyrics, and metadata) for the purposes of informing, training developing (or as input to) artificial intelligence technologies without authorization from the applicable rightsholders. You can limit and restrict the availability of certain of your Content to other users of the Platform, and to users of Linked Services, at any time using the permissions tab in the track edit section for each sound you upload, subject to the provisions of the Disclaimer section below."

Sounds like"lawyer speak" to me that hides a loophole big enough to sail an entire US naval battleship fleet through with room to spare.
