Hey Guys,
when I reproduce a playback with famous Jazzchanges (e.g. The Girl from Ipanema) without using the melody. what about copyright, GEMA and so on.
Can I use these playbacks and put them in an educational app, book etc.
How does it work with "iReal b" which has 1000 of famous playbacks. Would I have to contact each Composer?

Chord changes are not copyrightable, fortunately.
Neither are song titles.
The Melody of a song is copyrightable.

Unfortunately, it has been argued that transitional chords follow the rules of melody and harmony, and are not part of the chord structure. That is, is a transitional chord just a chord, or is it melody in three part harmony. If the transitional chords allow the tune to be recognized, you could have a problem.
A legal action can cost you everything you own, just to pay the lawyers, so it's as well to be sure of your ground.

I don´t realy get the term transitional chord. Maybe my English is too bad.
Please explain.
If I get you right you could refer a playback - let´s say - to Giant Steps as the melody ist strongly connected to harmonic movement.
The Girl from Ipanema consists more of a classical melody over a chordal background in these terms?

Hi PF.
There are various uses for transitional chords. One is as as link chords when changing key, but the use I was referring to was the use of chords to create melody with harmony.
As I'm sure you know (but I'll mention it in case you don't) there is a "natural" chord for each note of the scale, chords 1/4/5 being major, 2/3/6 minor and 7 diminished. Using these "natural" triads to play a melody ensures that the notes used are all scale notes and harmonically related. They are called transitional because they are used briefly as part of the melody. Holding a natural chord would stop it being transitional and it would become part of the chord chart and would need to be part of that progression.
Pianists and guitarists use this technique frequently. Hope this makes sense - it's a difficult subject to explain in a short space.

You should refer to the source for answers to copyrigh questions. The US Copyright office has a webpage with a pretty good FAQ and that is the source. http://www.copyright.gov/ (I would not aweat the transitional chord issue, personally.) And they won't "take everything you own" -- if you are indeed to ever be in violation of copyright with chord sheets for practice purposes, the likely first thing you will know about it will be the "cease and desist" letter from attorneys. Simply pull down the piece in question and you will have complied. --Mac
