Hallo zusammen,
wie ist das eigentlich mit dem Urheberrecht gelöst? Wenn ich eine Biab-Datei, z.B. von den Stones erstelle und sie anschließend einem Musikerfreund per Forum oder Email zur Verfügung stellen möchte, ist das erlaubt? Wenn ja, gibt es einen Pool, indem schon hergestellte BiaB-Dateien stehen, die man sich herunterladen darf? Im Netz stehen einige solcher Dateien, die sind aber alle sehr alt und meist jazzlastig. Ich suche Rockmusik und Rockballaden der letzten 40 Jahre. Kann mir jemand weiterhelfen? Ich sage jetzt schon Dankeschön.

Hallo, Kalledinia,
Das Urheberrechtsmetier ist nicht unknifflig und ich bin kein Jurist, darum sind diese Hinweise unverbindlich:
1) Komponisten/innen (und auch derne Nachkommen) haben einen Urheberschutz auf Titel, Komposition und Melodie der von ihnen erstellten Werke (zumindest, solange eine schutzwürdige Gestalthöhe erreicht ist). Dieser Urheberrechtsschutz erlischt in der Regel erst 70 Jahre nach dem Tod des/der Komponisten/in. Bis dahin erlaubt ist aber sehr wohl eine private Nutzung – also auch die unentgeltliche Weitergabe im Freundes- oder Familienkreis. Nicht erlaubt aber ist die öffentliche Weitergabe, zum Beispiel hier im Forum.
2) Schutz genießen aber auch ausführende MusikerInnen an Aufnahmen (also etwa eine CD, ein Stream oder ein Konzertmitschnitt). Auch hier gilt die Privatkopieschranke, du darfst Aufnahmen für dich kopieren und diese auch privat weitergeben, dies aber nicht öffentlich oder sogar kommerziell tun.
3) Nicht zuletzt haben Notenverlage einen noch weitergehenden Urheberschutz am gesetzten Notenbild: Du darfst nämclih noch nicht einmal für den privaten Gebrauch Fotokopien von gedruckten Noten anfertigen.
Der von Martin zitierte Hinweis bezieht sich vor allem auf den Punkt 2: Die RealTracks in Band in a Box sind von realen Musikern aufgenommen (teilweise sogar sehr namhaften). Diese Musiker (bzw. PGMusic) verzichten auf den Urheberschutz an diesen Aufnahmen. Du darfst also Musik, die du mit Band in a Box komponierst und produzierst, als eigene Werke verwenden, soweit du damit nicht die Rechte Dritter verletzt, also deine Komposition nicht eigenständig ist, sondern z.B. ein schon geschütztes Werk wiedergibt.
Wenn du aber mit dem Programm eine reine Begleitband generierst, ggf. auch mit Solistenspuren, dann darfst du das entstandene Musikstück im Allgemeinen frei nutzen, etwa als Telefonwartemusik oder auch als Soundtrack für ein kommerzielles Imagevideo. Du findest bei Spotify eine Vielzahl an (sehr seichter) Jazzclubmusik, die mit Band in a Box produziert ist, das sind reine Akkordfolgen ohne erkennbare Melodie. Damit lässt sich – als Fahrstuhlmusik – über Spotify scheinbar durchaus etwas Geld verdienen.
Du siehst es aber richtig: Du darfst BiaB-Dateien, die geschützte Kompositionen wiedergeben (also z.B. deine Stones-Stücke), nicht öffentlich weitergeben. In wie weit die private Weitergabe (also zum Beispiel auch per E-Mail oder Privatmail im Forum) zulässig ist, ist umstritten: Musikverlage sind der Ansicht, dass auch eine digitale Reproduktion von geschützten Noten der Fotokopie gleichzusetzen und also nicht zulässig ist. Es gibt aber auch die Ansicht, dass nur das gesetzte Druckbild dem Schutz unterliegt. Letztlich entscheiden können wird das im Zweifel nur ein Gericht mit Hilfe von Gutachtern – ich weiß aber nicht, ob überhaupt schon jemals zu dieser Frage Entscheidungen gefällt wurden.
Das Ganze ist also, wie so häufig im Juristischen, eine Sache, die nicht zweifelsfrei mit ja, nein, erlaubt oder verboten zu beantworten ist.
