I know that this question has been asked and answered before but after some lengthy searching, I've been unable to locate it in the forums. I assume that I CAN NOT give an old copy of BIAB to my brother without also abrogating my right to future product upgrades at a reduced price. Is that correct? I think the last time the question came up, someone was asking about donating an older program to a church or a school but I'll be darned if I can locate the thread.

I'd ask PG but I suspect answer is a NO. All other SW I own, LOTS OF IT from scores and scores of of vendors across a lot of disciplines, older versions that you UPGRADE from, and did not outright buy a NEW copies of (NEW not upgrade) cannot be sold or given away without losing your rights to use it and previous versions of "it."
Some SW I own, under their EULA's, state I can't even keep installed the OLDER version for my own use after I've upgraded to their newer version (that one I usually ignore unless new one indeed makes older one "inop." )
99.9% of the time ONLY ONE PERSON can "own" it (actually with way EULA's are written you are only renting SW anyway, but that's for another discussion).

Yep, I'm hoping PG music will jump in with an answer or someone has a link to the thread that I'm looking for. One would think that the answer would normally be that if you give the program away, you transfer ALL rights to the new owner which is the reasonable way to do business. I just thought I remember the person who was donating the program being told something else by PG Music. Since I can't find the thread, maybe I just dreamed it. Maybe an even better question is, If I have 3 activations available to me, can I assign one of those activations to a family member, a bandmate or a songwriting partner without violating my license?

Interesting question which can bring up a lot of real life and hypothetical situations, eg two brothers or sisters living in the same house, a computer each, one buys biab every year has three activations, does he activate a copy on his brother/sisters machine as well for him/her to use?
Now maybe he can, if he owns his brothers/sisters computer?
I would think that since the EULA is usually checked over by lawyers, or is it? that the above question is covered.
I look upon someone maybe selling their old version on ebay, just to recoup some cash as a different matter altogether, as I believe in that case you have to transfer the whole licence to use it to the buyer, including the current years one.
This is just my understanding of what I remember of the threads in question, so don't take it as fact.

Keith, I remember many such discussions. I believe the license is to one person, and Larry is correct. If you transfer the product, you transfer all of the product; in other words, you would have to buy it anew.

I understand it the same as Josie. It makes perfect sense that PG can't allow transferring the software to a third party.
