Hi all. Can some tell me if the question below applies to Band in a Box music? Thank you in advance. Rob4580
"Does your music or sound effects include any samples or beats that were obtained from a third-party website or source?"

The RealTracks are made from live studio recordings. Is this a question for copyright? The arrangements made by Band-in-a-Box, RealBand, and PowerTracks are yours, and your songs may be used freely as long as they don't infringe upon the intellectual property rights of others, such as with cover songs. https://www.pgmusic.com/salesfaq5.htm#23 The following add-ons are under PG Music Inc. copyright: Band-in-a-Box demo songs Performance Series songs MIDI Fakebooks (except the Sound Tracks MIDI Fakebooks) PowerTracks MultiTracks
Best, Chantelle

"Does your music or sound effects include any samples or beats that were obtained from a third-party website or source?" Yes. All of my songs contain sounds, effects, and sometimes samples and beats from third party sources. Sometimes I will replace BiaB drums with other MIDI drum loops, audio drum loops, and/or I will write my own. Remember that I work mostly in MIDI.
Back in my day the only time we started panic buying was when the bartender shouted "last call"!
64 bit Win 10 Pro, the latest BiaB/RB, Roland Octa-Capture audio interface, a ton of software/hardware

I'm not sure how much this helps, but...
If the only answers they offer are yes or no, it's a very tricky question to answer with anything other than traditional instruments. I have an electric piano and a synthesiser and they both use samples from a third party. All GM synthesisers will be the same. BiaB is the same. Kontakt instruments are the same, etc.
I imagine that a simple Yes answer, which is honest and accurate, will likely cause them to reject your submission. It's possible that answering No will simple mean you'll get further questions about attribution/copyright, though I suspect it won't.
If they're to police fully, then they really need that declaration of attribution/copyright, but I suspect that either they feel that leaves them too exposed, or they haven't thought it through properly.
If it were me, I'd be a little mischievous and ask them it it applies to samples inherent within an instrument like an electric piano. I personally would count BiaB as qualifying within that. If they say it does, then I cannot see how I could submit anything I produced to them.
Otherwise the only 'proper' option, IMHO, is to go elsewhere :-(

Yes -- that is a US Copyright Office registry form question. I take Chantelle's answer to be in sync with PGM's FAQs specifically #23 which Chantelle references. What I understand the USCO's question to infer is where the 3rd party content is the copyright of someone else. If you create a composition using strickly BIAB then per PGM you own that composition including the rendered sound recording (SR). Now if PGM does not mean the SR then they need to be specific about what they mean by "composition". That said you cannot claim copyright of a chord progression even if it has a unique rhymic feel. You can claim copyright of a melody whether it is played over a chord progression or not. (Though key and chords are implied anyway). Also the USCO is authenticating your claim of copyright through a legal review/registration process -- the government DOES NOT issue copyright in the USA. Because as citizens we have "natural copyright". But natural copyright is nearly impossible to prove in court. An alternative to the USCO registry is a service called https://SongSecure.comIt's $9.95/month unlimited registrations. See their website for details. Hope this helps.

I have written music for TV and movies. Including full instrumental songs as well as musical cues. The publishers I deal with don't care if you have a US registered copyright because the instant you create the music it is yours and you own the copyright. All they care is that you are the creator and are not stealing someone else's music. I see no benefit in paying the US Govt to register the copyright because the likelihood of someone stealing this music is very, very small.
Now if I am writing songs for recordings that will gain wide distribution, that is another story and I would register them in that case. PGM is pretty clear that anything you create in BIAB is yours to do with as you please, with their stated exceptions, the demos etc.
I think the confusion lies in what does the US Copyright office mean by samples and beats. I think, and this is purely my opinion, they mean sampled copyrighted music and or beats which is popular is different genres of music. If you sample a song and use it in your song, you probably need to be paying for it and giving it credit as required. Most sample software, loops etc. are specific to what you can do with their music. I have many loops that are free to use as I wish and others that require payment if I am to use them in a commercial recording.
I believe PGM has stated in the past that you do not need to credit the real tracks musicians and indeed you may not want to as was mentioned elsewhere, it might infringe on their rights. They are musicians for hire and have been paid for what they did is PGM's stance as I have read elsewhere in previous discussions about this.
Once again, this is just what I remember and my opinion and not legal advice.
You need to ask the USCO what they mean by the question and then speak with PGM directly to address any questions you may have as this is just a user forum and while PGM answers here frequently, it may not be sufficient.
My wife asked if I had seen the dog bowl. I told her I didn't even know he could.
