Ciao, si era aperta una discussione sulle canzoni italiane in biab.
Avevo anche detto la mia, cioè utilizzare import di midi per combinarci un pò di lavoro sopra. Parlavo ovviamente di midi regolari, cioè comprati attraverso le varie modalità ( midisong, ad esempio).
Che fine ha fatto la discussione ? Sembra essere sparito tutto.

E' vero, ho dovuto eliminare la discussione perché PGMusic temeva che il progetto potesse andare contro la normativa sul copyright. D'altra parte, pur avendo avuto commenti positivi dagli affezionati, nessuno aveva aggiunto altri brani oltre ai (pochi) che stavo aggiungendo io. Non sono esperto della normativa, magari Sergio può illuminarci in merito. Ti dirò che anch'io, fra l'altro, ho usato sempre Biab proprio come fai tu, anche per fare un po' di karaoke con gli amici. Ho collezionato come tanti una gran quantità di file midi e kar italiani, e con Band in a Box che li apre e mi dice subito gli accordi, proietto il testo su un altro schermo, e nelle nostre serate fra amici mi diverto a strimpellare sul pezzo. Faccio un figurone (eh,eh,eh!)

OK, ho capito, nessun problema !
Un contributo per la discussione con i colleghi competenti ( seranto & ginni ).
Se è vero che le produzioni con biab sono fuori dalla problematica di copyright,
elaborare un midi comprato secondo regole (ripeto: ad esempio con i download da 1 € dai
siti dedicati) non dovrebbe comportare nessun problema conseguente ( proprietà transitiva
applicata al copyright...!).
Comunque: se pur interessante, non è un argomento "core" di BIAB; nel dubbio hai fatto bene a
comportarti con prudenza. Apprezzo !

Ciao a tutti, intervengo volentieri sull’argomento, ma non tanto perchè mi ritengo esperto della materia, purtroppo parlare di copyright è sempre difficile, si rischiano cantonate pazzesche. Avevo già maturato l’idea di introdurre l’argomento su quel Post, poi essendo stato cancellato . . . Mi documentai molto in passato sulla materia, sia in concomitanza con l’organizzazione di eventi o spettacoli musicali importanti (come mole di pubblico) sia con la preparazione di spettacolini in stile parrocchiale (tipo sagre di quartiere). Ma ho affondato i denti nella questione anche in tempi più recenti, prima di dedicare un sito all'utilizzo di BiaB. Consultai anche PG Music e le indicazioni datemi (poche ma incisive) mi suggerirono uno standard comportamentale che da allora consiglio a tutti, credo permetta di vivere sereni e privi di timori. Prima di tutto qualche dato informativo, alcuni stralci dalla Legge 22 Aprile 1941 N.633 Protezione del Diritto d'Autore e di altri diritti connessi al suo esercizio. In risposta a:
Art. 4. ... sono altresi protette le elaborazioni di carattere creativo dell'opera stessa, quali le traduzioni in altra lingua, le trasformazioni da una in altra forma letteraria od artistica, le modificazioni ed aggiunte che costituiscono un rifacimento sostanziale dell'opera originaria, gli adattamenti, le riduzioni, i compendi, le variazioni non costituenti opera originale.
Art. 16. Il diritto esclusivo di comunicazione al pubblico ..., comprende altresi, la messa a disposizione del pubblico dell'opera in maniera che ciascuno possa avervi accesso dal luogo e nel momento scelti individualmente.
Art. 17. 1. Il diritto esclusivo di distribuzione ha per oggetto la messa in commercio o in circolazione, o comunque a disposizione, del pubblico, con qualsiasi mezzo ed a qualsiasi titolo, dell'originale dell'opera o degli esemplari di essa ....
Ecco ora invece il testo della FAQ 22 di PG Music:
In risposta a:
22. Are songs that I create with Band-in-a-Box copyrighted?
The arrangements made by Band-in-a-Box are yours, and your songs may be used freely as long as they don't infringe upon the intellectual property rights of others.
Conclusioni: l’Articolo 4 temo non lasci dubbi, se prendo Azzurro di Celentano, la trasformo con l’aiuto di BiaB in un beguine, anche se aggiungo un ‘solo di clarinetto in stile bebop, sale, pepe, mostarda e origano . . . rimane sempre una canzone di Celentano, e nel momento in cui la metto a disposizione di altri per il download (non importa se come mp3, spartito o come file proprietario di un qualsiasi altro software) commetto una violazione del copyright.
Tutte le composizioni invece che creiamo dal nulla con BiaB sono libere da copyright, ma . . . non dimentichiamo mai che gli Styles (compresi le parti strumentali in RealTracks) sono stati prodotti ispirandosi a composizioni esistenti o a stili compositivi di autori più o meno famosi. La probabilità di creare canzoni che assomiglino spaventosamente ad altre esistenti (al punto da sembrarne una copia!) è molto alta.
Ho accennato all’inizio di questo mio intervento alla scelta che feci nel stabilire uno standard comportamentale (parlo ovviamente per me stesso!), i motivi appena esposti diedero l’input decisivo, in pratica: se non è farina del mio sacco (mi riferisco alle composizioni già esistenti) non ho diritto di farne alcunchè IN PUBBLICO, quel che creo invece con BiaB lo metto a disposizione senza chiedere compensi perché così ritengo sia giusto. Naturalmente su quest’ultimo punto potete dissentire, ognuno di noi deve prendere questa decisione autonomamente, secondo le sue convinzioni e filosofie di vita.
Mi scuso per la lunghezza, spero almeno d’esser stato utile.

Scusa Cuke, mi sono dimenticato di fare una precisazione riguardante questa tua frase: In risposta a:

sempre e soprattutto basandosi sull'Articolo 4, non ha alcuna rilevanza che l'opera sia in formato audio, cartaceo, midifile o altro, è sempre protetta da copyright.
Se l'hai acquistata regolarmente hai diritto ad effettuarne una copia di sicurezza ad uso personale, ed anch'essa dev'essere considerata protetta. Quindi l'acquisto non da diritto alla diffusione, basta pensare a radio e televisione, anche loro acquistano CD Audio e musica in formati vari, ma poi per diffonderla nell'etere pagano ancora, purtroppo (per noi utenti finali) e per fortuna (per autori e . . . "Società varie") questa è la Legge.

Condivido; non è mai tempo perso quello investito nel capire.
Provo a sintetizzare per vedere se ho capito, anche ad uso dei colleghi che ci leggono:
1) midi file comprato = midi di cui posso fare quello che voglio privatamente
2) midi file comprato e rielaborato da BIAB: idem come sopra
3) file BIAB autocomposto: ne faccio cosa voglio sia privatamente che in pubblico, con i limiti di rischio che giustamente poni tu circa gli style
4)per l'utilizzo in pubblico distinguerei ancora:
a)spettacolo = normativa SIAE (casi 1 e 2 ), no siae per caso 3).
b)copie per amici = bè, si ricade nella normativa "lucro/non scopo di lucro" et similia, di cui si discute in merito alle masterizzazioni, e di cui si sarebbe dovuto discutere quando usavamo le duplicazioni di cassette....
Con un codice etico come quello da te proposto penso che ci si ponga in una zona di rispetto, soprattutto in considerazione di cosa capita attorno !

Perfetto, il tuo riepilogo è ottimamente in linea con quanto volevo far capire.
Giustissimo anche il tuo riferimento alla duplicazione di cassette, non ho mai compreso bene queste forme di lotta/lamentela/protesta, una cosa si e una no! se esiste un "al di là" quando entrerò nel Club chiederò lumi in merito (speriamo non ci siano discriminazioni anche da quelle parti? forse bisogna portarsi dietro un avvocato!).

Scusate se continuo l'argomento; premetto che sono nuovo del forum, ma "vecchio" nel campo, nel senso che strimpello da svariati anni, prima con gruppo musicale che si esibiva nelle piazze, suonando dal vivo "ante Midi" e computer, poi in piano bar con basi midi ed accompagnamenti automatici, ed adesso per diletto a casa.
Fermo restando che quanto detto sinora è chiaro e giusto nei confronti degli autori che ci campano con il loro lavoro, però avere una discussione nel forum che tratti di "trasformazione" di una base midi regolarmente acquistata ed utilizzata nei limiti imposti dalla legislazione, non dovrebbe costituire un problema.
Mi spiego, so che se trasformo, arrangio, modifico etc. una base midi con BiaB la potrò utilizzare solo esclusivamente per uso privato, mentre in pubblico ho l'onere di pagare i diritti di autore, ergo compilazione del "borderò".
In sintesi, perché cancellare una discussione simile quando sono chiare e legali le precisazioni?
Grazie, e scusate se ho detto delle inesattezze.

AI posteri e agli amici l'ardua sentenza. Lo ripeto, fermi restando gli usi consentiti dalla legge dei brani MIDI con copyright, PGMusic, che è attentissima a qualunque uso illegale del programma, mi ha chiesto di non promuovere su questo sito discussioni che potessero metterla in difficoltà, e così ho fatto. Se poi avete un modo per portare avanti temi interessanti per tutti senza infrangere la normativa in proposito, ben venga.

la normativa sui diritti d autore è internazionale.
presempio ce tutta la musica del mondo su Biab, non la musica italiana.
In un paese normale la Siae sarebbe stata indagata, e avrebbero verosimilmente pagato per illeciti rapporti.
da noi è solo stata commissariata per irregolarita per oltre un decennio.
In Italia sono i controllori a derogare le regole.
