It's something that a user could easily do accidently and end up losing a track; completely ruining the existing track. Seems like it would be worth changing to behave like it did in your first example; if it asked if I wanted to put it on a given track at least my attention would be drawn to it and I could avoid the mistake.
That's all. Make it ask that thrid question in this situation instead of just overwriting one of my existing tracks without asking..
I'm sure it could be done.Jeff will probably say just use the undo.
