In un primo momento stavo per replicare all'ultimo intervento di Ginni nel topic Facciamocci sentire - 2 (realmente) ma l'argomento copyright va approfondito perchè è una cosa seria ed ho ritenuto più utile dedicare uno spazio apposito dove scambiarci pareri, anche se riguarda solo in parte l'uso di Band-in-a-Box. La legge sul Diritto d'autore, almeno in Italia, è un po' ... particolare; da qualche parte ho già espresso il mio convinto parere, cioè che essa è come un tessuto elastico che cambia forma in funzione di chi lo indossa. Però potremmo anche convincerci tutti (mi metto nel mucchio anch'io naturalmente!) del principio che dobbiamo rispettare il lavoro degli altri, in qualsiasi forma appaia. Dando per scontato questo principio, proviamo a porci questa banale domanda: l'ho fatta io questa cosa? no, allora se non è roba mia devo chiedere il permesso all'autore. E' vero Ginni che una successione di accordi non può essere protetta da copyright, ma un arrangiamento si, praticamente lo è sempre. RIporto alcuni stralci dalla Legge 22 Aprile 1941 (nonostante la data è  "attualissima") , N.633 Protezione del Diritto d'Autore e di altri diritti connessi al suo esercizio. Art. 4. ... sono altresi protette le elaborazioni di carattere creativo dell'opera stessa, quali le traduzioni in altra lingua, le trasformazioni da una in altra forma letteraria od artistica, le modificazioni ed aggiunte che costituiscono un rifacimento sostanziale dell'opera originaria, gli adattamenti, le riduzioni, i compendi, le variazioni non costituenti opera originale. Art. 16. Il diritto esclusivo di comunicazione al pubblico ..., comprende altresi, la messa a disposizione del pubblico dell'opera in maniera che ciascuno possa avervi accesso dal luogo e nel momento scelti individualmente. Art. 17. 1. Il diritto esclusivo di distribuzione ha per oggetto la messa in commercio o in circolazione, o comunque a disposizione, del pubblico, con qualsiasi mezzo ed a qualsiasi titolo, dell'originale dell'opera o degli esemplari di essa .... Facciamo un esempio: io riarrangio ( senza la parte melodica!) Summertime di George e Ira Gershwin (a proposito, in Italia nel Luglio 2011 tutte le musiche di George Gershwin entreranno nel Pubblico dominio), ne faccio una Salsa proprio con l'aiuto di BiaB, e metto a disposizione nel Web il file di BiaB con l'arrangiamento creato e specificando chiaramente che è una versione di Summertime. Ho violato il Diritto d'autore, avrei dovuto registrare il mio nuovo arrangiamento alla SIAE, a nome di George Gershwin, Ira Gershwin e Sergio A., ma non avrei potuto mettere a disposizione il nuovo arrangiamento senza dichiararlo alla SIAE ed espletare così tutti gli obblighi del caso, compreso il versamento periodico agli autori di un compenso calcolato (mi sembra mensilmente) in base ai clic che riceve il file al momento del download. L'alternativa: metto l'arrangiamento sul Web ( sempre senza parte melodica!) e senza specificare che si tratta di Summertime, non commetto nessuna violazione sul copyright perchè non è reato usufruire di una successione di accordi già sfruttata, ma ... che senso ha? tanto vale che ci sbatto una nuova melodia e intitolo il file Bingo bongo. Dunque allora per come interpreto il tuo esempio, se io faccio un arrangiamento di Summertime per un cliente che lo vuole usare come Karaoke, e non lo chiamo Summertime ma in un altro modo, non devo pagare nessun copyright, giusto ? Per esempio: http://www.sergiomarcello.com/music/sunny_1.mp3Riuscite a capire in quale altra canzone - molto nota - sono usati gli stessi accordi ? Va beh, il titolo del file vi aiuta di certo, ma obiettivamente, se non vi dicessi che si tratta di Sunny, lo avreste scoperto da soli ? In questo caso, quale copyright sto infrangendo ? Sergio.

Non sono proprio certo che sia giusto e conveniente basarsi solo sull'ascolto per giudicare se un brano è simile ad altri. Sembra la cosa più ovvia ma ho delle perplessità.
Ho scritto di "successione di accordi" non protetta, e direi che dev'essere ovvio, altrimenti non scriverebbe canzoni più nessuno già da qualche decennio.
Però . . . utilizzare gli accordi di una Song famosa può essere più o meno semplice e più o meno rischioso ma dipende dal resto dell'arrangiamento. Quando una commissione valuta una denuncia di plagio, utilizza dei criteri ben precisi che, pur se non sono in grado di spiegarti, sono abbastanza sicuro si basano su un'analisi comparativa delle reali note messe sul pentagramma, e solo in parte minore sull'ascolto del brano.
Se io volessi creare un doppione di Summertime innanzitutto cambierei completamente la melodia, modificherei più possibile i passaggi strumentali che caratterizzano di più l'arrangiamento, muterei (anche se di poco) il tempo metronometrico e magari la tonalità, ma attento adesso al mio ragionamento: in pratica così facendo ho quasi scritto una nuova canzone, cosa mai potrà assomigliare all'originale? torniamo al punto di partenza "solo la successione di accordi".
A parer mio non dovremmo dimenticare di considerare un'altra cosina nel tema copyright: l'onestà. Mi spiego: credo che non esista più per nessuno la possibilità di creare nuova musica che non richiami alla memoria una musica già composta da altri, siamo sommersi da suoni e musica ogni giorno e ritengo impossibile vivere senza esserne condizionati. Perciò per non incorrere in guai consiglierei chi è interessato/intenzionato a creare arrangiamenti, canzoni o video, di evitare il caos mentale e scegliere una via semplice, farsi cioè una banale domandina prima di distribuire il proprio lavoro (indipendentemente dal fatto che venga retribuito o meno):

Riapro quest'argomento e non prima di essermi cosparso di ceneri!! Ho dato un'informazione sbagliata e mi scuso con tutti coloro che l'hanno letta. Purtroppo la Legge Italiana sul Diritto d'Autore, come tutte le Leggi ormai datate, è stata spesso ritoccata, sicuramente questo verrà fatto ancora fintanto che qualcuno con un po' di sale in testa non si deciderà a buttare via tutto ed a riscrivere una Legge seria tutta nuova e al passo coi tempi. In risposta a:
in Italia nel Luglio 2011 tutte le musiche di George Gershwin entreranno nel Pubblico dominio
è una dichiarazione sbagliata, difetta in più di un particolare ma soprattutto quando l'ho scritta mi basavo sul fatto che in Italia una canzone potesse entrare in Pubblico Dominio 76 anni dopo la morte dell'Autore o dell'ultimo coautore sopravvissuto, cioè i 70 anni specificati dalla Legge stessa, più un'ulteriore periodo di 6 anni che prorogava questo limite grazie al Decreto legislativo luogotenenziale 20 Luglio 1945 n. 440 pubblicato ai tempi del . . . Regno d'Italia!!).
In realtà ho scoperto da poco (ahime!!) che questo Decreto legislativo è stato abrogato negli anni 90 (non m'ero accorto che in quel periodo al Parlamento qualcuno aveva gli occhi aperti!), per cui in Italia al momento in cui scrivo è attivo solo il limite di 70 anni.
Per chiarire più a fondo la questione faccio un esempio:
Summertime (da Porgy and Bess) fu composta da George Gershwin e Edwin DuBose Heyward, scomparsi rispettivamente nel 1937 e nel 1940, le opere che hanno composto assieme sono in Pubblico Dominio dal Gennaio 2011.
Dance Alone With You fu composta dai fratelli George e Ira Gershwin, però mentre George scomparse come già detto nel 1937, Ira morì nel 1983, per cui le composizioni create assieme dai fratelli entreranno in Pubblico Dominio dal 2053, perchè si deve far riferimento alla morte dell'ultimo coautore (in questo caso Ira Gershwin).

Jazz, Funk & World (Sets 468-475):
Our new jazz, funk & blues RealTracks include a groovin’ collection of RealTracks and RealDrums! These include more requested “soul jazz” RealTracks featuring artists Neil Swainson (bass), Charles Treadway (organ), Brent Mason (guitar), and Wes Little (drums). There are new “smooth jazz” styles (4), which include a RealTracks first: muted trumpet, as well as slick new smooth jazz brushes options for drums.
