A while back I was listening to some of the demo soundtracks in BiaB, and was intrigued by one song "Harem Dance", and played around with it a little, changed the melody instrument to minimoog and liked it... Posted it on soundcloud, but have since wondering if this is ok with PG-Music?

I also would love to know what melodist created that specific melody? Since there is no memo of which melodist used in the song memo, how can we figure it out?

If the song has a melody, and you didn't create the melody, then you are infringing copyright (just as you suspected). In the same way, if you use the Melodist to create a melody, you become copyright owner of that melody. (I've often used the Melodist to give me a starting place with creating a song. It's a fantastic tool.)

While chord progressions and genre-based standard accompaniment patterns (like waltz, rock, blues, swing, rhumba, etc.) are not copyrightable, melody and lyric are copyrightable. Song-specific signature musical breaks and fills also have potential to attract copyright.

Ah, ok.. Thank's a lot Noel for ur always helpful answers... But, just to clarify; All the demo soundtracks in BiaB is copyrighted?

So then again, my next question is; How can we figure out what melodist made that kind of melody? Because, like this one, is just unlike anything I have heard from the BiaB melodist.. Hence, my suggestion in the suggestion forum, to have the melodist maker automatically included in the song memo, but no one so far seems to second that one...

So, should I delete that song?

I'm not a copyright lawyer so my answers are based on my understanding only. Even though I've read fairly widely on copyright, I'm not claiming to be absolutely correct. My experience is that it's better to err on the side of being cautious.

So to answer your questions...

The demo soundtracks are audio files that have been created by PG Music. This means that PG Music own those files and the copyright associated with them. If, however, you load the song demo chords into BIAB and then create your own backing using the chosen style, the new audio file is your creation and you own the copyright (assuming you don't use PG Music's melody).

I'm not sure that it's possible any other way than trial and error... just trying out different melody styles.

It's not necessary that anyone second it. PG Music read the Wishlist forum and make a note of the suggestions. Over the years, I've seen many un-seconded suggestions implemented.

I'd leave the song there but acknowledge PG Music. Since you've been upfront with this post, they will know that you have it on Soundcloud. If PG Music ask you to delete it, then delete it. By acknowledging PG Music on Soundcloud, I mean saying something like.... "The melody of this song was created by PG Music and is the property of PG Music. It was made as the demo for the style "add the style here" in Band In A Box." (or equivalent).

Melodies are copyrightable but not chord progressions.

With BB you are free to use everything there for your own. If you use the demo songs.... simply do as you did and change the melody. I have considered doing that myself but so far have not.

Everything BB creates for you is considered to be your creation and you are free to copyright it and use it.

I have a number of songs in music libraries that were created 100% in BB and those songs are listed under my account as being written by me. Copyright with pubs and libraries can work slightly different from just an individual filing a copyright. Technically, I don't own them any more, the publisher does, but I'm still the writer and have the rights accorded in the contract. Same protection but a different path to get there.

So yeah, feel free to do what you did without worry.

BTW: Cool song interpretation. If you hadn't titled the thread infringement, I would never have guessed. And..... BTW, it's not infringement.

Agree... changing the melody solves the problem. If Trygve did that, he's on safe ground.

In Trygve's original post he says he changed the instrument for the melody and not the melody. Unless I've misinterpreted what he said, to use an existing melody with a different instrument still infringes copyright.

Because melody saves with BIAB, if the melody that Trygve mentions was created by PG Music for the demo, it will be a midi melody and would load with the song when the file is opened. If it is a midi melody, it's very easy to change the notes using either Notation Mode or the Piano Roll. That would solve any potential copyright issues.

Thank's a lot for the advice Noel and Herb ! Made me a lot wiser... Next time I will just do as u said Noel, not change only the instrument but also the melody...

I added; "The melody of this song was created by PG Music and is the property of PG Music. It was made as the demo for the style "Exotic1.sty" in Band In A Box." to the track info, so I guess it should be ok then...
