Legality can depend on the purpose for doing it, and permissions granted.

I had a friend that made a video for youtube, crashed his system and lost the video, which he had done in Flash as a school project while he had access to that software. He had no way to do anything with the video anymore.
I retrieved the file and burned to DVD for him, so there are 'legitimate' uses.. even though they may not be encouraged by the site. Had to weigh that one out before I did it.

Plus some people just may not know how to burn proper DVD's. Family videos posted there would be another reason I could see for doing it (with the owners permission of course). Easier to post it once somewhere and send family the link than it is to send it to eveybody, especially with file size restrictions on emails.
