The creation of the work can be assigned to ChatGPT.

Because computers can't enter into contracts, ChatGPT can't have the copyright for the work.

That is, the copyright is the right to say who and how the work can be copied. And ChatGPT isn't recognized as legal entity that can do that.

But don't worry - if a company can be considered to have free speech, I'm sure there are people who will eventually enshrine AI's right to enter into a legal contract.
