Gibson has also issued Cease & Desist order to certain companies selling guitars promoted by certain people ... just protecting their brand against an incoming threat to the arts

A cheap counterfeit, can ruin the reputation of the band it mimics.

If I purchase a cheap, off-brand LP design with an off-brand name on the headstock, I can say this off-brand company makes crap.

If I purchase an off-brand LP with Gibson on the headstock, I might think Gibson makes junk.

So Gibson is protecting it's image, and I think that's a good thing.

TBH, they drew attention to themselves in an excessive manner.

Gibson probably wants no part of politics, and I don't blame them as a musical instrument manufacturer.
I wouldn't doubt some companies pay Gibson/Fender like that, but they get to choose if they approve it.

With all of the Strat, LPs, 335s, etc, copies out there I wonder if the guitar body shapes are copyrighted?

Does anyone know?

According to Guitar World, the 130-year-old guitar manufacturer confirmed that it had sent the warning to ***** Guitars owner 16 Creative “as the design infringes upon Gibson’s exclusive trademarks, particularly the iconic Les Paul body shape.”

I went into a pawn shop a few years ago and I spotted this real pretty Gibson Les Paul. The price tag was a mere $500. I was shocked and was scoping out that guitar when the shop owner asked me if I wanted to check it out. I asked him what was wrong with it because there was no way he was selling this for $500.
He then told me it was a counterfeit guitar and he got ripped off. He was just trying to recover his loss.
He showed me all the details that Gibson had sent him to identify the counterfeit guitar. I remember one of the things was the truss rod cover was not the same. Also the pots and capacitors were not right either. Of course I did not buy the guitar but it sure fooled me.

There are builders making guitars indistinguishable from, or arguably better than, modern Gibsons. This is also true for vintage Gibsons, where the margins are considerably higher. The higher volume builders are perhaps in Asia, but the issue is not Asian, it is global. I have no issue with Gibson, or anybody else, defending their intellectual property irrespective of the quality.

The high end watch business is a similar mess.

I remember when tokai made strat and tele copies back in the 80s and contemporary guitar press reviews were excellent. Copies with other names on the headstock aren't fakes. I read Guitar magazine in the UK and a peavey USA made strat style guitar beat a fender in a head to head. If the guitar has an honest headstock it's worth judging on its own merits.

There's a big difference between a copy/replica of the real thing and a counterfeit of the real thing.

The first one is ok because it is marketed as a knockoff whereas the second one pretends to be the real thing.

3000 counterfeits in circulation would be a really bad thing. That would have been a nice bonfire 🔥 to watch.....or maybe a wood chipper.

The current owners of Gibson are replowing old ground. Trademarks must be continually protected or they become lost — as they recently found out with Mastertone.

This means pursuing counterfeits and re-filing suits that they won and lost in the 1970s – '80s.
