With the advent of AI generated music, a lot of publishers and sync libraries are obviously concerned about the use of said music in their catalogs since the status for copyright is still very much in dispute. Currently, the consensus is that AI generated music is not copyrightable and since the pubs business model is totally dependent on control of copyright, it's a problem for them to use AI generated music.

I've heard other individuals make the comment that you just don't have to tell them if AI was involved in the process. So go ahead and send them your AI generated crap and don't tell them, simply claim it as your own.

Ahhhh yes..... But there's just one little problem with that.

Digital watermarks.

You can Google that topic and you'll find some very interesting papers on the various aspects of watermarking digital compositions.

It mostly involves adding a high frequency, low level digital watermark signal to the entire file. It goes start to finish. And it's well above the range of human hearing, and in other cases, below or some combination of both including the DC bias. They're working on making it extremely hard to detect by ear, and impossible to remove without significantly damaging the original recording. It's a given, and both Suno and Udio are using a watermarking algorithm for everything they generate. Using even a small section of the song exposed that watermark to detection by any decoder being used by publishing companies to screen the song as they listen to your submission.

Here's one of the smaller stories on the topic with examples of the start of a song on one of the major platforms. People say that the noise is a result of the compression algorithm but the real question is, is that a watermark placed in the coding by the platform? Then of course when you compare the quality of AI to a studio production, what's with all the noise, or lower audio quality in the AI? Is it just artifacts or something else, like the watermark?

What they can not prevent you from doing is listening to the AI-generated song and playing it out live note for note.
I assume the lyrics can not even be proven in a court of law to have been generated by AI. Is the AI model that you use going to record and save every set of lyrics that it ever generated and save what IP address it was sent to?

I have no idea if AI could generate a truly great song. The three I generated through AI were pretty amazing, but far away from anything I thought was great. They were plausible at best.

I am sure there are a certain number of people who will buy third-rate AI-generated songs, but that will not have much effect on great songcreators.

I see AI as a pretty good, simplistic rhyming dictionary that could give me insight into how a Dylan song was constructed. But I bet you 10 bucks it never considered Dylan Thomas in the equation.

Ai can give me an idea of what a modern country song could sound like but it never drove over to Bakersfield...lol

I don't buy into the idea that AI knows everything.

It is a very useful tool that can be abused just like a knife or a hammer could be used to kill someone. Or a zillion other ways to lie, cheat, and steal. Why would it knot? It learned from us.

The more we try to prevent people from breaking "laws" related to money, the more they will find ways around the issue.

AI is only artificial, not intelligent. The breakthrough promised since WWII has yet to happen and may never.

With the settlement of the WGA and SAG strikes, we have already reached the stage where one must prove that work is original in order to get paid. It can be inspired or helped by AI but must be created by humans before you can go around raising money. In other words, all commercial projects fall under this umbrella. The big publishers are demanding proof—too much money at stake—and they will not pay without it. Publishing and Performance royalties are where all of the big money is in the music business.

No, I'm not talking about the millions of AI generated loops and songs that no one will ever hear. Spotify now gets over 250,000 submissions a week. How much of that gets into rotation? Practically none as we all know.

There are new commercial services promising "access to millions of royalty-free soundbites" to use in your projects. Oh really? I'm consulting on licensing issues concerning these as creators will want to be paid while protecting themselves against being ripped off—the services want to be indemnified against the rampant theft and lax security that will result. Digital watermarking is the only known protection so far that has half a chance.

I have a ringside seat plus a number of NDAs that ensure my silence beyond broad generalities.
