It is not a slam dunk. The Bette Midler case never made the ride to SCOTUS. Estates have been able to protect the likeness/image for decades but voice sound-alike has very little case law besides Bette Midler.
The use of AI in this regard has opened the floodgates of litigation but until there have been a few more high profile cases with huge awards, nothing is certain.
