That sounds like an old known bug that was fixed.

You must not have applied the Update Patch:

Note that the fix for Upper Bank Patches and Hardware Synths was implemented in Build 281 - but you should download and install Build 282, which contains all the good stuff in previous Builds plus adds its own. That way you get all updates available.

And your Upper Banks should then "stick".
